[pct-l] USFS-Inyo NF Bear Cannister requirements reference



Joanne, here's a reference & an excerpt from the official USFS "Order" =
requiring bear cannisters - I got a hard copy from the friendly folks at =
the Bishop Ranger Station in May:

  Order No. 04-97-01 (promulgated pursuant to 36 CFR 261.50 (a) & (b), =
and implementing 36 CFR 261.58(cc)),=20

  "Occupancy and Use Restriction: Proper Food Storage in Wilderness." =20

  "Pursuant to 36 CFR 261.50(a) and (b) and for the protection of the =
public (italics mine), the following act is prohibited within the John =
Muir, Ansel Adams, Golden Trout, Hoover, Boundary Peak, Inyo Mountains, =
and South Sierra Wilderness areas of the Inyo National Forest.
    Possessing or storing any food or refuse unless stored in a =
bear-proof container or in another manner designed to keep bears from =
gaining access to the food or refuse.  36 CFR 261.58(cc).

    ... (remainder omitted - deals with exemptions for officials, etc.)
  This prohibition is in addition to the general prohibitions in 36 CFR =
Part 261, Subpart A.

own PDF file.  The reg doesn't include the "order" and I've been having =
trouble using the federal General Printing Office search engine to find =
an electronic copy of it.  I've e-mailed them to see if they have a =
direct link to the 1997 Federal Register citation where it was =
published. =20

Also, the bear-proof <VBG> container regulation was promulgated as an =
"order" without a definitions section.  To get an interpretation for =
your particular requirements, maybe you can write or e-mail the Forest =
Supervisor for the Inyo to get an interpretive letter.  Bureaucratic, =
yes, but it would be sufficient to wave to any field ranger!  At least, =
imho, that SHOULD work. =20
